1. Description of service

TEMPER is a fitness and body transformation platform that provides workout tracking, nutrition logging, body composition monitoring, AI-powered coaching, social features, and related health and fitness tools. TEMPER is designed for informational and motivational purposes and is not a substitute for professional medical advice, diagnosis, or treatment.

2. Eligibility

You must be at least 17 years old to use TEMPER. By using the app, you represent that you meet this requirement.

3. Account registration

You may create an account using Sign In with Apple or email registration. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate information and to update it as needed.

4. Subscriptions and payments

TEMPER offers the following subscription plans:

• TEMPER Pro: $19.99/month or $119.99/year
• TEMPER Coach: $49.99/month or $399.99/year

All subscriptions include a 7-day free trial for new subscribers. Payment is processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID settings.

Prices may vary by region and are subject to change. Any price changes will be communicated in advance.

5. Health and fitness disclaimer

TEMPER provides fitness tracking, nutrition information, and AI-generated recommendations for informational purposes only. The app is not a medical device and does not provide medical advice. Always consult a qualified healthcare professional before starting any diet or exercise program, especially if you have pre-existing health conditions. You use the app's recommendations at your own risk.

The AI Coach feature provides automated recommendations based on the data you input. While we strive for accuracy, AI-generated advice may not account for all individual health factors. It is not a replacement for professional coaching or medical guidance.

6. User content and social features

You may post content including workout logs, progress photos, comments, and share cards through the app's social features. You retain ownership of your content but grant TEMPER a non-exclusive, worldwide license to display and distribute your content within the app and associated marketing materials.

You agree not to post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. We reserve the right to remove content that violates these terms.

7. Acceptable use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the app
• Interfere with the app's functionality or other users' experience
• Create fake accounts or misrepresent your identity
• Scrape, harvest, or collect data from other users
• Use the app to distribute spam, malware, or harmful content

8. Intellectual property

TEMPER, its logo, design, and all related intellectual property are owned by us. You may not copy, modify, distribute, or create derivative works based on the app without our written permission.

9. Data and privacy

Your use of TEMPER is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Limitation of liability

To the maximum extent permitted by law, TEMPER and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to physical injury, health complications, data loss, or loss of profits.

The app is provided "as is" without warranties of any kind, either express or implied.

11. Termination

We may suspend or terminate your access to TEMPER at our discretion if you violate these terms. You may delete your account at any time through the app settings.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated through the app. Continued use after changes constitutes acceptance.

13. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
